Prayer : Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the 2nd Respondent to grant Moratorium to petitioner as per circular of 1st Respondent-Reserve bank of India dated 27.3.2020(vide circular No. DOR No. BP.BC 47/21.04.048 / 2019 -

20) and 23.05.2020(vide circular No. DOR No. BP.BC.71 / 21.04.048 / 2019 -20) for the period starting from 01.03.2020 till 31.8.2020.

(Through Video Conferencing) After some arguments, learned counsel appearing for the petitioner seeks permission of this Court to withdraw this writ petition, with liberty to avail alternative remedy by making https://hcservices.ecourts.gov.in/hcservices/

challenge to the possession notice, dated 09.09.2020, and also undertakes to send an endorsement to that effect, through email, to the Registry of this Court. 2.Heard the submissions of the learned Standing Counsel appearing for the 2nd respondent also.

3.If the petitioner is so advised and if it is available to him under law, it is open to him to avail the alternative remedy in respect of the possession notice, dated 09.09.2020, issued by the 2nd respondent.

This writ petition is dismissed as withdrawn with the aforesaid liberty.

No costs.

Consequently, connected miscellaneous petition is closed.
