in O.P.No.182 of 2013 M.SUNDAR,J., When the matter was taken up Mr.P.Raja, learned counsel representing Mr.T.S.Baskaran, counsel on record for R1 and Mr.S.Kumar, learned counsel of M/s.Vijay Anand Associates (Law Firm), counsel on record for all the other parties are before us.

2. Both the learned counsel representing all the parties submitted in unison in one voice that the matter has since been settled out of Court and both counsel have made a joint common endorsement in the case file and a scanned reproduction of the same is as follows:

3.Both learned counsel reiterated the aforementioned endorsement and request for closure of captioned application.

4. In the light of the narrative thus far, captioned application i.e., A.No.1305 of 2021 is disposed of as closed albeit on above terms. To be noted, the parties have resorted to this course as the original order of Section 34 Court was made on 25.04.2019 and thereafter in the light of Hakeem principle, namely ratio laid down by Hon'ble Supreme Court in Project Director NHAI Vs. M.Hakeem reported in (2021) 9 SCC 1 which was rendered on 20.07.2021, there can be no modification of the award. There shall be no order as to costs.
