This transfer civil miscellaneous petition is filed seeking to withdraw the HMOP No.119 of 2023 from the file of the Sub Court, Avinashi and transfer the same to the Family Court, Coimbatore District.

2. Despite service of notice on the respondent, none appeared on his behalf.
3. I have heard the counsel for the petitioner and have also gone through the affidavit filed in support of the transfer application.
4. The petitioner who is the wife, is the respondent in HMOP.No.119 of 2023 before the Sub Court, Avinashi which has been filed by the respondenthusband seeking restitution of conjugal rights. The petitioner has filed HMOP.No.759 of 2024 seeking dissolution of marriage which is pending on the file of Family Court, Coimbatore. The petitioner has further stated that she is unable to travel from Coimbatore to Avinashi and also expresses inconvenience.
5. Hence, I am inclined to accept the request for transfer of HMOP.No.119 of 2023 pending on the file of Sub Court Avinashi is hereby withdrawn from its file and transferred to the file of Family Court, Coimbatore to be tried along with HMOP.No.759 of 2024 and M.C.No.81 of 2024.
