This Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 2 and 3 to take necessary action on the representation of the petitioner dated 11.09.2020 within a stipulated time.

ORDER

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the second and third respondent to take necessary action on the representation made by the petitioner on 11.09.2020, wherein the petitioner is seeking for cancellation of the patta issued in favour of the fourth respondent. 2.

Mr.E.Balamurugan, learned Special Government Pleader appearing on behalf of the respondents 1 to 3 submitted that the third respondent has called the parties for preliminary enquiry on 11.12.2020 at 11.00 a.m. The learned Special Government https://hcservices.ecourts.gov.in/hcservices/

Pleader submitted that the third respondent will conduct preliminary enquiry and thereafter, submit a report before the second respondent and the second respondent will, thereafter, pass orders strictly in accordance with law. The learned counsel further submitted that the petitioner can be present at the time of enquiry along with all the relevant documents. 3.

Taking into consideration the facts and circumstances of the case and also of the fact that the third respondent has already called the parties for preliminary enquiry, there shall be a direction to the third respondent to conduct the enquiry after providing sufficient opportunity to the petitioner and the fourth respondent and shall submit a report to the second respondent within a period of six weeks from the date of receipt of a copy of this order. The second respondent, on receipt of the report from the third respondent, shall pass final orders strictly in accordance with law, within a period of four weeks thereafter.

This Writ Petition is disposed of with the above directions. No costs.
