Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of the order bearing No.CP-PU1/1540/2026-R2 dated 21.05.2026 passed by the respondent No.2 and quash the same and direct the respondents to grant ordinary leave for 40 days without escort to the petitioner's brother namely Ramesh @ Sori Ramesh, S/o. Arul Das, aged 44 years, bearing OJCT.No.2007, who is presently incarcerated at Central Prison - I, Puzhal. 1/4

O R D E R

(Order of the Court was made by G.R.SWAMINATHAN, J.

) Heard both sides.

2. The petitioner's younger brother, namely Ramesh @ Sori Ramesh, Son of Arul Das, is undergoing life sentence in the second respondent Prison. Their mother is presently on her deathbed. The petitioner's brother has spent more than twenty years in prison. We are inclined to grant leave to the convictprisoner.

3. We direct the respondents to grant forty (40) days ordinary leave for the convict without escort.

4. Accordingly, the impugned order dated 21.05.2026 is quashed and the writ petition is allowed on the following conditions:~ (a) The convict-prisoner, Ramesh @ Sori Ramesh, Son of Arul Das, aged 44 years, bearing OJCT.No.2007, confined at Central Prison-I, Puzhal, is granted ordinary leave for forty (40) days from 03.06.2026 to 12.07.2026 without escort.

(b) The convict prisoner shall be released from the prison at 05.00 p.m., on 02.06.2026 and he shall return to the prison at 10.00 a.m., on 13.07.2026. (c) During the said leave period, he shall report before the Inspector of Police, Villivakkam Police Station, Chennai, daily at 07.00 p.m., from 03.06.2026 onwards, without fail.

(d) During the leave period, the convict prisoner shall abide by all the conditions prescribed in the Jail Manual.
