The learned counsel for the petitioners submits that since the petitioners are ready and willing to pay the victims and settle the entire issue, this case may be treated as an exceptional case. This apart, he would also submit that the petitioners are not the original persons who accepted the deposits and defaulted, but took over the Company subsequently.
2.Considering the two reasons aforestated and the undertaking given by the petitioners to pay the substantial part of fine amount, this case may be treated as an exceptional case and exemption from surrendering is granted.
