The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 294(b) and 307 of IPC in Crime No.338 of 2022, seeks anticipatory bail.

2. Heard both sides.

3. There are totally fifteen accused. The case of the prosecution is that due to previous enmity, there arose a wordy quarrel between the petitioners and the defacto complainant, as a result of which, the petitioners attacked the defacto complainant and caused injuries to him. Hence, the complaint.

4. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Therefore, he prays to grant anticipatory bail to the petitioners.

5. The learned Additional Public Prosecutor would submit that the petitioners have attacked the defacto complainant and caused grievous injuries to him. He would further submit that the injured is still in hospital and there are eight stitches on his head. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.

6. Considering the nature of offence committed by the petitioners, the injured is still in hospital, as custodial interrogation of the petitioners is very much required, this Court is not inclined to grant bail to the petitioners.
