The Criminal Original Petition is filed to quash the F.I.R. in Crime No.458 of 2023 on the file of the first respondent-Police.

Learned Counsel appearing for the petitioner submitted that there is a property dispute between the petitioner and the de-facto complainant, in which, the first respondent/Police is unnecessarily interfering and trying to give a criminal colour to the civil dispute. Therefore, the F.I.R., in Crime No.458 of 2023 may be quashed as against the petitioner herein.

3. Learned Government Advocate (Crl.Side) appearing for the first respondent/Police submitted that investigation in Crime No.458 of 2023 is over and charge-sheet has already been filed before the Jurisdictional Court.

4. On a perusal of the records and considering the submissions made by the learned counsel on either side, this Court is of the view that since investigation has already been completed and charge sheet has also 2/4

been filed and also prima facie there are materials against the petitioner to proceed with the case further and hence, this Court is not inclined to entertain this petition by invoking Section 528 BNSS,2023.

5. In view of the above, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed. 12.06.2025 Index : Yes/No Speaking Order : Yes/No ms To 1.
