Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to direct the respondents to keep post of Assistant Agricultural Officer in Dharmapuri District (IN WMP.NO.19040 OF 2019) pending disposal of the above writ petition NO.19550 PF 2019. Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.K.RAJA, Advocate for the petitioner and of MRS.NARMADHASAMPATH ADDITIONAL ADVOCATE GENERAL ASSISTED BY MRS.A.SRIJAYANTHI, ADDITIONAL GOVERNMENT PLEADER FOR 2 & 3 Respondents and of MR.M.LOGANATHAN on behalf of the Respondents the court made the following order:- This petition has been filed seeking to direct the respondents to keep one post of Assistant Agricultural Officer vacant in Dharmapuri District pending disposal of the above writ petition.
2. The respondent filed a counter on 22.08.2019, in which in para 3, it has been stated that the petitioner has wrongly mentioned her date of birth as 10.06.1988 instead of 10.06.1998 while applying for the recruitment. Hence, her application was rejected as per clause 12 (L) of the Commissioner's Notification https://hcservices.ecourts.gov.in/hcservices/
issued for the said post. The selection to the said post had already been finalised on 28.06.2019 itself. However,this Court has passed interim order on 08.07.2019 to keep one post vacant to the petitioner, after finalisation of the entire list.
3. The learned Additional Advocate General would submit that in view of the finalisation of the entire list, the respondents are not able to comply with the order passed by this Court and prays to close this petition.
4. Mr.K.Raja, the learned counsel for the petitioner would submit that the appointment order was issued on 13.09.2019 only after the interim order. However, he would further submit that all the issues are left open in the main petition.
