Respondents PRAYER : Writ Petition filed under Article 226 of Constitution of India, to issue Writ of Certiorarified Mandamus to call for the records pertaining to endorsement bearing Rc.No.30366/Rect.II(1)/2009 dated 01.10.2011 on the file of the second respondent and quash the same in so far as it denies the rights of the petitioners for having their seniority fixed among the Sub Inspectors of Police belonging to Batch I of 1997 - 1998 recruits, appointed on 16.04.1999 candidates as per the marks given in Police training college to the Batch I (1999) and the petitioners and consequently direct the respondents 1 to 3 to fix the seniority of the petitioners among the Batch I candidates (1999) strictly on the basis of their Police Training Marks in the Final examination with all consequential monetary and service benefits.

When the matter was taken up for hearing on 08.08.2024 there was no representation on behalf of the petitioners, hence Registry was directed to list the matter on 12.08.2024 under the caption " for orders". Today when the matter is taken up for hearing there is no representation on behalf of the petitioners.

The learned Additional Advocate General submitted that the writ petition was filed for fixation of seniority of the petitioners among the SubInspector of Police belonging to Batch 1 of 1997 - 1998 as per marks given in Police training College to the Batch I (1999) and consequently fix the seniority of the petitioners among the Batch 1 candidates. The learned Additional Advocate General submitted that the State wise draft seniority for the year 1997 - 1998 for over all state on the basis of Police Training Marks in final examination was released and objections were called for from the affected persons.
3. The learned Additional Advocate General further submitted that the petitioners submitted their objections to the draft seniority list released on 31.01.2021.
4. The learned Additional Advocate General therefore submitted that the prayer in the writ petition has become infructuous as the draft seniority list for 1997-1998 as prayed by the petitioners has been prepared. I agree with the learned Additional Advocate General, but at the same time, as the petitioners have given their objections to the draft seniority list (1997-1998), the respondents are directed to consider the objections of the petitioners in accordance with law while finalising the seniority list.
5. With the above observation and direction, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are also closed. 12.08.2024 dpq Index : Yes /No Speaking Order : Yes/No
