O R D E R

This Writ Petition (Criminal) has been filed by the petitioner to direct the first respondent police to appropriately correct the FIR in Crime No.08/2025 to include the Tractor No.TN49CY8003 which has caused the accident and investigate the same preferably by another Investigating Officer other than the second respondent.

2. The learned Senior Counsel appearing for the petitioner submitted that the Investigating Officer by colluding with the owner of the offending Tractor, not conducting the investigation properly. Therefore, the present petition is filed seeking transfer of investigation.

3. The learned Government Advocate (Crl. Side) appearing for the first respondent police submitted that the investigation is under progress.

4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the first respondent police and also perused the materials available on record.

5. Since no adverse order is being passed, notice to the second respondent is dispensed with.

6. It is seen that the investigation is already in progress and for mere apprehension, the investigation cannot be transfered.

7. Therefore, this Writ Petition (Criminal) is dismissed. Consequently, the connected Miscellaneous Petition is closed.

8. However, the respondent police is directed to expedite the investigation and file the charge sheet within a period of three months from the date of receipt of a copy of this order. 13.06.2025 ksa-2 Index:Yes/No Speaking Order: Yes/No
