PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, calling for the records relating to impugned Letter No.1519/CN2/2023-2, dated 27.04.2023 passed by the 5th respondent herein and quash the same as being illegal, arbitrary, unconstitutional.

O R D E R

The writ petition is filed challenging the order passed by the 5th respondent directing the 2nd respondent to transfer the petitioner, who is the President of Co-operative Society to some other place.

2. The writ petition was filed mainly on the ground that the post of President of the Panchayat is not a transferable post. The learned counsel for the petitioner submitted that the petitioner's term of office came to an end on 06.08.2023.

When the matter is taken up for hearing the learned Additional Government Pleader appearing for the respondents 1 to 5 submitted that the period of the petitioner is already over and an administrator has been appointed for the society. Since the period of the petitioner is already over and he is no longer holding the post of President, the issue raised by the petitioner need not be gone into, as there is no possibility to implement the impugned order.

4. Accordingly, the writ petition is dismissed as infructuous. No costs. Consequently, the connected miscellaneous petitions are closed. 24.08.2023 Index : Yes/No Speaking order:Yes/No dm 3/4
