A.No.3944 of 2021 in C.S.No.440 of 2017 A.No.3944 of 2021 in C.S.No.440 of 2017 N.SESHASAYEE, J., In the suit, the settlor have been served with summons on 19.9.2017, and it was set exparte on 14.02.2018, and an exparte decree was passed on 20.11.2018.

2. Pursuant to the decree passed, the plaintiff has laid the execution petition, and on receiving the notice, the defendant has promptly come to this Court with application to set aside the exparte order and also to condone the delay of 998 days in filing the said application.

3. Heard both sides. For the present, this Court is inclined to allow this application in A.No.3944 of 2021, on condition that the applicant is paying a cost of Rs.10,000/- to the plaintiff on or before 10.12.2021.

4. Post the matter on 15.12.2021.
