The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 77 of Juvenile Justice (Care and Protection of Children) Act and 20(B)IIA, 8(c) of NDPS Act, in Cr.No.15 of 2024, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 19.01.2024 at around 8.45 a.m., by receiving credible information that some persons are selling Ganja to Youngsters and School students near light house, the respondent police arrived the occurrence place and arrested the accused persons and seized 120 grams of Ganja. Based on the confession of arrested accused, the petitioner was implicated in this case. Hence, the complaint. 3.The learned counsel appearing for the petitioner submitted Page No.1/4

that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner.

4.The learned Additional Public Prosecutor (Puducherry) appearing for the respondent police submitted that there are 9 previous cases pending as against the petitioner and the petitioner is supplier of Ganja and he is a history sheeter. He further submitted that the investigation is at initial stage. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5.Considering the fact that there are 9 previous cases pending against the petitioner and he is the history sheeter and also considering the gravity of offence, this Court is not inclined to grant anticipatory bail to the petitioner.
