Respondents Prayer: Writ Petition filed under Article 226 of Constitution of India praying for issuance of Writ of Mandamus directing the 2nd respondent to pass order on the representation given by the petitioner dated 23.09.2020 for cancellation of bogus patta standing in the names of the 4th respondent in respect of the property comprised in Survey No.5/2 measuring extent of 0.56.00 Hectare and 3/7B, measuring 0.9.83 hectare Ponneri Village, Viruthachalam Taluk, Cuddalore District.

ORDER

This writ petition has been filed for the issue of Writ of Mandamus directing the 2nd respondent to consider the representation made by the petitioner on 23.09.2020, wherein, the petitioner is seeking for cancelation of the patta issued in favour of the 4th respondent with respect to the subject property.

2. Mr.Arul Dass, learned Govt. Advocate appearing on behalf of the respondents 1 to 3 submitted that the 3rd respondent has called the parties for preliminary enquiry on 16.12.2020 at 11 a.m. The learned counsel submitted that the petitioner can be present at the time of enquiry along with all the relevant documents.

3. Taking into consideration the facts and circumstances of the case and also of the fact that the 3rd respondent has already called the petitioner for enquiry, there shall be a direction to the 3rd respondent to conduct an enquriy after affording opportunity to the petitioner and the 4th respondent and the 3rd respondent shall submit a report before the 2nd respondent within a period of six weeks from the date of receipt of a copy of this order. The 2nd respondent on receipt of the report shall pass final orders strictly in accordance with law within a period of four weeks thereafter.

4. This Writ Petition is disposed of with the above direction . No costs.
