Respondents Petition filed under Sections 11(6) of the Arbitration and Conciliation Act, 1996, to appoint an Arbitrator for the respondents to adjudicate the claims/disputes arising out of the work order in No.1260/PHB/EE/DB/2005-06/440 dated 14.8.2007 issued by the second respondent to the petitioner.

O R D E R

The affidavit filed by the respondents has been perused. In view of the aforesaid and in view of the order passed in O.P.No.889 of

2015 dated 01.04.2016, the learned counsel for parties propose and agree that Mr.D.Ramabathiran, a retired Judicial Officer be appointed as the Sole Arbitrator and the venue of arbitration be at Puducherry.

2. I, thus, appoint Mr.D.Ramabathiran, a retired Judicial Officer, No.19, First Cross Road, Sri Guru Sithananda Swamy Nagar, Navarkulam, Lawspet, Puducherry-605 008 as the Sole Arbitrator to enter upon the reference and adjudicate the disputes inter se the parties. The venue of arbitration will be Pudhucherry. The fee of the Arbitrator will be governed by the Rules of the Madras High Court Arbitration Centre (MHCAC) (Administrative Cost and Arbitrators' Fees) Rules, 2014,

3. The Original Petition is, accordingly, allowed, leaving the parties to bear their own costs.
