The petitioner has filed the above Writ Petition to issue a Writ of Mandamus, directing the 1st respondent to consider the petitioner's appeal petition dated 09.05.2014, within a time frame.
2. Mr. K. Kannadasan, learned counsel appearing for the petitioner submitted that though the petitioner has filed the appeal before the 1st respondent challenging the grant of patta by the 2nd respondent in favour of the 3rd respondent as early as https://hcservices.ecourts.gov.in/hcservices/
on 09.05.2014, the 1st respondent has not disposed of the appeal yet.
3. Mr. B. Nambiselvan, learned Additional Government Pleader (Pondicherry), appearing for the respondents 1 and submitted that the 1st respondent may be directed to dispose of the appeal, within a time frame.
4. Mr. R.Sunil Kumar, learned counsel appearing for the 3rd respondent submitted that the 1st respondent may be directed to dispose of the appeal, after giving opportunity of hearing to the petitioner as well as the 3rd respondent.
5. Having regard to the submissions made by the learned counsel on either side, taking into consideration the limited prayer sought for by the learned counsel for the petitioner, without expressing any opinion with regard to the merits of the case, I direct the 1st respondent to consider the petitioner's appeal dated 09.05.2014 and dispose of the same, after giving opportunity of hearing to the petitioner as well as the 3rd respondent, within a period of eight weeks from the date of receipt of a copy of this order.
With these observations, the Writ Petition is disposed of. No costs.
