Respondents Petition filed under Section 482 of the Criminal Procedure Code, to direct the first respondent to transfer the investigation from the third respondent to the second respondent in connection with Crime No.507 of 2015 on the file of the third respondent and investigate the matter in accordance with law on the basis of the complaint given by the petitioner dated 21.12.2015 to the first respondent.

O R D E R

This Criminal Original Petition has been filed to direct

the first respondent to transfer the investigation from the file of the third respondent to the file of the second respondent in respect of Crime No.507 of 2015 pending on the file of the third respondent, and to further direct the second respondent to investigate the matter in accordance with law on the basis of the complaint given by the petitioner dated 21.12.2015 to the first respondent.

2.When this Criminal Original Petition was taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents submitted that already investigation has been completed in Crime No.507 of 2015 and charge sheet is also made ready to be filed before the jurisdictional Magistrate. For filing the charge sheet, he seeks time.

3.The above statement made by the learned Additional Public Prosecutor is recorded and the third respondent is directed to file the charge sheet before the concerned Court, within a period of four weeks from the date of receipt of a copy of this order. On filing of the charge sheet, the learned Magistrate shall proceed and pass appropriate orders.

4.With the above direction, the Criminal Original Petition is disposed of.
