ORDER
This Criminal Original Petition has been filed, seeking to direct the learned Principal Sessions Judge, Kallakurichi, the Special Court, Kallakurichi District to consider bail application of the petitioner herein on the same day of surrendering in Crime No. 357 of 2024 pending on the file of the 3rd respondent police.
2. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents and also perused the materials available on record.
3. Considering the above submission made by the learned counsel on either side, it is seen that the petitioner is A8. It is alleged that there was a wordy quarrel between the petitioner and the de facto complainant, during which the petitioner abused the de facto complainant by uttering his caste name, and intentionally humiliated him on the basis of his caste, and assaulted him. Based on these allegations, the present case has been registered.
4. In view of the specific bar under Section 18 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and also taking into
consideration the possibility of misusing the pious intention of the Parliament against innocent persons, there shall be a direction to the jurisdictional Court, to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No.357 of 2024 on the file of the third respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioner shall surrender before the jurisdictional Court within a period of fifteen days from the date of receipt of a copy of this order.
