It is an yet another case filed by the petitioner invoking the provisions of Right to Information Act, 2005. 2.Right to Information Act, 2005 (Shortly "the Act") has been enacted with the highest objects of providing information to every citizen, the transparency and good administration of Government Departments and in order to promote transparency and accountability in the working of every Public Authority, the constitution of a Central Information Commission and State Information Commissions and for matters connected therewith and transparency of information which are vital to its functioning and also to contain corruption and to hold Governments, efficient operations of the Governments, optimum use limited fiscal resources and the preservation of confidentiality of sensitive information.
The Act provides for information asked by any citizen without assigning any reason subject to certain exemptions. But, it has become an order of the day for everyone to sparing the Public Authorities with battery of questions whether relevant or irrelevant. 3.It is a peculiar and interesting case of an Officer of the highest cadre constituted for this purpose for rescue. During the sitting of the Commission the Registrar brought to the notice of the Commission that an appellant by name Thiru B.Bharathi, 57 Kavi Kuil Street, Ashok Nagar, Lawspet, Puducherry has been presenting appeal petition after appeal petitions (more than 50 petitions) to the Commission against many of the Public Authorities within a span of three months. He has also not spared this Commission and the High Court.
He met the Chief Information Commissioner a few weeks back and represented that he has filed several appeals and that they could be disposed of very quickly. He was assured of early disposal depending upon the number of appeals which came up before the Commission. He had on a subsequent day called on State Information Commissioner Thiru T.Srinivasan and conducted himself in a rude and offensive way.
After a few days, he has written a letter to the Commission stating that meeting with Chief Information Commissioner itself was not of any avail, and has questioned the decision of the Commission on a few petitions. Subsequently he had been visiting the office of the State Information Commission very frequently as also calling on telephone different officials including the Private Secretaries of the State Information Commissioners and Chief Information Commissioner. It has been brought to the Commission's notice that during these visits and telephone calls he was using intemperate, offensive and foul language with the officials of the Commission. His written appeals also contain unparliamentary and offensive language which can be taken as slander tantamounting to contempt of Court.
2)Perusing the appeal petition, the notes submitted by the staff and officers of the Commission as also their oral complaints the Commission considers that the action of the individual is highly reprehensible, condemnable and would fall within the definition of criminal
contempt. He has willfully caused disturbance and intimidation to the Commission which is performing a Judicial function as far as the Right to Information Act is concerned.
3)Section 18(3) of the RTI confers the status of Civil Court to the State Information Commission. The action of the above individual in the past few weeks has been to continually disturb the Commission's functioning. This action and language of the individual is offensive, intimidatory and scurrilous, beyond condonable limits, amounting to scandalizing the 'court'.
The Commission has therefore passed the following orders:
1) The Registrar of the Tamil Nadu Information Commission is directed not to entertain any appeal / petition/ letter from this individual henceforth.
2) The Registrar shall also ensure that the individual does not gain entry into the premises of the Tamil Nadu Information Commission, as he has been found to be interfering with the functioning of staff and officers.
3) The Registrar is also directed to instruct the officers and staff concerned not to entertain him in future even on telephone. 4) The Registrar is also directed by the Commission to initiate contempt proceedings as delineated in chapter XXVI of the Code of Criminal Procedure, 1973 read with Section 228 I.P.C should the individual continue in his act in future."
4.The matter does not stop with this. The petitioner had gone further and sparing questions to the Commission repeatedly through his wife. His wife was informed that the information sought for pertains to third party and no public interest was involved and rejected her letter under Section 8(1)(i) of the Act. The said reply dated 23.04.2013 of the State Information Commission is put under challenge before this Court.

7.The conduct of the petitioner is demonstrated from his own applications filed under the Act. It is nothing but abuse of
process of law and particular statute, which was enacted for achieving transparency with regard to administration. Thousands of questions raised by the citizens taking undue advantage of the Act will result in hanging the system and efficient administration. It will disproportionately divert the manpower of the administration from discharging the normal duties of their office. Such attempt shall not be encouraged even though the Act provides for no limitations.
8.Therefore, the writ petition is dismissed. This is a fit case for imposing heavy costs. However, considering the petitioner's plight, this Court restrain itself from doing so. No costs. Consequently, connected miscellaneous petitions are closed.
