This miscellaneous petition has been preferred to suspend the sentence imposed on the petitioner in S.C.C.No.27 of 2019 dated 09.11.2020 by the learned Sessions Judge, Special Court for Exclusive Trial of Cases under POSCO Act, Coimbatore and enlarge the petitioner on bail. 2.Heard the learned counsel on either side and perused the materials available on record.
3.When the matter was taken up for hearing on 18.08.2022, the learned Government Advocate appearing for the respondent sought time for filing counter and disposal, however, counter has not yet been filed.
4. It seems that since the offences involved in the present case is POSCO Act, this Court is not inclined to suspend the sentence and hence, this Miscellaneous Petition is dismissed. On the other hand, this Court is inclined to take up the main appeal itself ''for final disposal'' soon after receipt of the entire records.
5.The Registry is directed to call for the records from the Court below on or before 21.09.2022 and thereafter, prepare typed set of papers on or before 30.09.2022 and serve copies on the learned counsel on either side well in advance.
6.List the matter under the caption ''for final disposal'' on 14.10.2022.
