This Criminal Original Petition is filed challenging the concurrent findings of the Court below in dismissing the application filed under Section 311 of Cr.P.C.

2. This Court, on perusing the order passed by the Trial Court as well as the revision Court finds no perversity in it. It is a tactics to delay the process as rightly observed by the trial Court.

3. Private complaint instituted in the year 2019 for dishonouring the cheque is now posted for arguments. At the fag-end of the trial, an application is filed to produce documents of the year 2012 which was very much available with the petitioner on the day when complaint was filed. Therefore, there is no satisfactory reason to entertain the petition under Section 311 of Cr.P.C.

4. Hence, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous Petitions are closed. 22.08.2024 Index : Yes/No.
