The petitioners, who were arrested and remanded to judicial custody on 02.07.2022 for the offences punishable under Sections 8(c) r/w 22(b) of NDPS Act in Crime No.273 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioners were found in illegal possession of Tapentadol Tablets100 mg Tydol-200 tablets and Nitrazepam Tablets -390 tablets. Hence, the case.

3. The learned Government Advocate (Criminal Side) would submit that both the accused persons were selling Tapendatol tables and Nitrazepam tablets to the school and college students. Hence, he vehemently opposed to grant bail to the petitioner.

4. There are totally tow accused, in which the petitioners are arrayed as A1 and A2. Both the accused persons were jointly possessing Tapentadol Tablets100 mg Tydol-200 tablets and Nitrazepam Tablets -390 tablets. It is a commercial quantity. That apart, the petitioners failed to fulfill the twin conditions as contemplated under Section 37 of the NDPS Act. Therefore, this Court is not inclined to grant bail to the petitioners and this Criminal Original Petition is dismissed.
