Order (Order of the Court was made by G.R.Swaminathan J.) Heard both sides.
2. The petitioner suffered an eviction order under Section 6 of the Tamil Nadu Land Encroachment Act, 1906. This is appealable. We permit the petitioner to file an appeal before the District Collector under Section 10 of the Act. If the petitioner files such an appeal within four weeks from the date of receipt of a copy of this order, the same shall be disposed of as expeditiously as possible without reference to limitation. Till the District Collector disposes of the petitioner's appeal, the impugned eviction order shall not be enforced.
3. The writ petition is disposed of accordingly. We have not gone into the merits of the matter. No costs. Consequently, connected miscellaneous petitions are closed.
