ORDER

The petitioner, who was arrested and remanded to judicial custody on 13.04.2026 for the alleged offences under Sections 296 (b), 118 (1), 115 (2), 351 (2), 75 (3) of BNS, 2023 r/w Section 4 of TN Prohibition of Harassment of Women Act, 2002, in Crime No.89 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 07.04.2026, at 8.00 a.m., the petitioner and his friend were consuming alcohol on the terrace of the defacto-

complainant's residence. It is alleged that when questioned about this, the petitioner assaulted the defacto-complainant with a wooden log, kicked her and caused injuries. Hence the case.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 13.04.2026. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. He also submitted that injured has been discharged from the hospital. Hence, he prays to grant bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has seven previous cases out of which, two under Section 307 of the I.P.C, one under the NDPS Act, and three hurt cases. Hence, he opposed for grant of bail to the petitioner.

5.The submission of the learned Government Advocate clearly demonstrates the petitioner's bad antecedents and character. Therefore, this Court is of the firm view that although the petitioner's liberty must be respected, when considering the societal interest, the petitioner appears to be a repeat offender. If the petitioner is enlarged on bail, there is every possibility of

recurrence of similar offences. Hence, this is not a fit case to enlarge the petitioner on bail.
