Writ petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents herein, their subordinates or agents from in any manner harassing the petitioner, its dealers and distributors in their carrying on business in production, distribution and sales of VCD/DVD's with Copy Rights without conducting any enquiry and without valid or reasonable grounds in accordance with law. ORDER
The writ petition has been filed to direct the respondents herein, their subordinates or agents from in any manner harassing the petitioner, its dealers and distributors in their carrying on business in production, distribution and sales of VCD/DVD's with Copy Rights without conducting any enquiry and without valid or reasonable grounds in accordance with law.
2. The case of the petitioner is that the 3rd respondent and his subordinate officials are arbitrarily seizing VCD's/DVD's in respect of films for which the petitioner has copyright without giving any opportunity to the petitioner to furnish the documents as to copyright and substantiate the same.
3. Heard both sides and perused the documents available on record.
4. Considering the facts and circumstances of the case, this Court directs the respondents and their subordinates that they shall not harass the petitioner in their carrying on business, without conducting any enquiry on the complaint. With the above directions, this Writ Petition stands disposed of. No costs.
