Prayer : Criminal Original Petition filed under Section 528 of BNSS, to direct the second respondent to initiate appropriate action against the mother-in-law and sister-in-law of my deceased wife, for abetting my wife to commit a suicide as stated in the final report dated 17.01.2022. For Petitioner : Mr.M.Dinesh For Respondents : Dr.C.E.Pratap, Government Advocate (Crl.Side) ****** 1/4
ORDER
This petition is filed seeking to direct the second respondent to initiate action against the petitioner's mother-in-law and sister-in-law. According to learned counsel for the petitioner, the petitioner's mother-in-law and sister-in-law have fraudulently mutated the revenue documents in their favour with regard to the properties stood in the name of petitioner's deceased wife. Further the petitioner, after demise of his wife, permitted his mother-in-law and sister-in-law to take care of his children, but, now the petitioner did not know even the whereabouts of the children. Therefore action has necessarily to be initiated against the petitioner's mother-in-law and sister-in-law. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondents and perused the materials available on record.
2/4
It is seen that the dispute is between the family members and the allegation of the petitioner also revolves around the property and custody and visitation of his children. Therefore this Court is not inclined to exercise power under Section 528 BNSS for the relief sought for in this petition.
Accordingly, this Criminal Original Petition stands dismissed. However, the petitioner is at liberty to workout his remedy before the competent Court.
