ORDER

This writ petition has been filed seeking a writ in the nature of mandamus, directing the 1st respondent not to make further recovery from the salary of the petitioner without furnishing the loan amount payable to him to the 2nd respondent.

2. Today, the learned counsel for the petitioner submitted that he has been furnished with the details with regard to nature of the amount payable and the amount recovered and to be recovered and therefore, nothing survives for adjudication in the writ petition and the same may be dismissed. However, he submitted that for the delayed action on the part of the society, the petitioner cannot be held responsible and therefore, he made a request to the court that a liberty may be given to the petitioner to challenge the claim in respect of the interest.

3. In the result , the writ petition is dismissed as infructuous, however, giving liberty to the petitioner to challenge the claim in respect of the interest. No costs. Consequently, connected WMP is closed. 13..07..2023 Index : yes / no : yes / no Speaking / Non Speaking Order kmk
