Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition no. (C) that the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of two weeks imposed by this Hon`ble Court in Crl.O.P.No.13175 of 2021 by way of order dated 29.07.2021.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. K.PRADEEP RAJ, Advocate for the Petitioner and of MR.A.GOPINATH, Govt. Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- The Petitioner has filed this petition seeking to modify the condition directing the petitioner to appear before the respondent police in the order dated 29.07.2021 made in Crl.O.P.No.13175 of 2021. 2.The learned counsel appearing for the petitioner submitted that the petitioner is working in Uttarpradesh and hence he is not in a position to appear before the respondent police daily and prayed this Court to modify the condition.
3.Heard the submissions made by the learned Government Advocate (Crl. Side).
4.This Court perused the order dated 29.07.2021 made in Crl.O.P.No.13175 of 2021, wherein, this Court has directed the petitioner to appear before the respondent police daily at 10.30 a.m., only for a period of two weeks and thereafter as and when required for interrogation. This Court also perused the grounds raised in the petition. There is no valid reason raised for modification of the said condition. Hence, this Court is not inclined to grant the relief sought for in this petition.
5.This petition is dismissed. The petitioner is directed to comply with the condition imposed on him in the order dated 29.07.2021 made in Crl.O.P.No.13175 of 2021, failing which, the anticipatory bail granted to him shall stand automatically vacated, without any further reference to this Court.
