This application has been filed seeking permission to withdraw a sum of Rs.12/- Lakhs which had been deposited by the applicant to the credit of Arb.O.P.No.39 of 2023.

2.In the affidavit filed in support of the application it had been stated that the applicant had filed Arb.O.P.No.39 of 2023 under Section 34(2)(c) of the Arbitration and Conciliation Act, 1996 questioning the award which was passed to his disadvantage. At the time when the Arbitration Original Petition came up for initial hearing, a condition was imposed that the applicant should deposit a sum of Rs.12/- Lakhs. Accordingly, the said sum was deposited. Subsequently, the Arbitration Original Petition was came up for final hearing and by order dated 04.04.2024, the Original Petition itself was allowed. 3.Naturally, the petitioner is now entitled for return of the said amount of Rs.12/- Lakhs which had been deposited to the credit of Arb.O.P.No.39 of 2023. The Registry may to do the needful and on proper identification, issue a cheque in the name of the applicant or in the name of the learned counsel.
