Prayer: Writ Petition is filed under Article 226 of he Constitution of India, seeking to issue a Writ of Mandamus, to direct the respondents to extend the benefit of G.O.Ms.No.210 School Education (G1) Department dated 14.08.2009 and G.O.Ms.NO.190 School Education Department dated 12.07.2010 to the petitioner by counting his earlier service in the post of Secondary Grad Teacher as well as Primary School Head Master/ B.T.Assitant/ Tamil Pandit along with the services rendered by him in the 1/4

post of Middle School Head Master and award the pay scale of Selection / Special Grade Scale of pay with effect from 01.06.1998 and accordingly revise the pension and other pensionary benefits and also to pay the arrears. ORDER

This Writ Petition is filed seeking for direction to the respondent to extend the benefit of G.O.Ms.No.210 School Education (G1) Department dated 14.08.2009 and G.O.Ms.NO.190 School Education Department dated 12.07.2010 to the petitioner by counting his earlier service in the posts of Secondary Grade Teacher as well as Primary School Head Master/ B.T. Assistant/ Tamil Pandit along with the services rendered by him in the post of Middle School Head Master and award the pay scale of Selection / Special Grade Scale of pay with effect from 01.06.1998 and accordingly revise the pension and other pensionary benefits and also to pay the arrears.

2. Learned counsel for the petitioner reported that petitioner is no more and the legal heirs of the deceased petitioner are not coming forward to prosecute this Writ Petition for time being, this Writ Petition can be closed. 2/4

However, if the legal heirs of the deceased comes forward to prosecute the Writ Petition, they are at liberty to approach this Court, with appropriate application.
