This writ petition has been filed seeking a Writ of Mandamus, directing the respondents to consider the petitioner's complaint dated 09.04.2018 and consequently, direct the respondents to give protection to the petitioner and his family members.
2. Today, Mr.A.Thangavel, HC 1501, Kallakurichi Police Station, Villupuram District, is present before this Court.
3. Heard Mr.S.N.Subramani, learned counsel for the petitioner and Mr.D.Raja, learned Additional Government Pleader for the respondents.
4. On a reading of the affidavit filed by the petitioner, it is seen that the petitioner had entered into a construction agreement with one Eswaran on 01.06.2016 and there appears to be a dispute between the petitioner and the said Eswaran with regard to the construction work. While so, it is alleged by the petitioner that on 10.01.2017, Eswaran and his men had obtained signature in blank papers and had ransacked his office. In this regard, the petitioner has given a complaint https://hcservices.ecourts.gov.in/hcservices/
only on 09.04.2018 and thereafter, filed the present petition for police protection. In a case of this nature, where the dispute is essentially contractual, this Court cannot give police protection to the petitioner. However, if there is any fresh assault on the petitioner, he shall approach the local police and the same shall be enquired into and action taken in accordance with law. No costs.
