Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of certiorarified mandamus calling for the records of the respondents 1 to 3 in connection with the impugned orders passed by them in DO No.1250/2005 in C No.H1/46673/2004 dated 28.09.2005, RC No.121938/Conf.I(2)/2004 dated 13.08.2014 RC No.B1/1517/12441/2005 dated 28.08.2014 respectively and C No.H1/08262/2005 dated 03.09.2014 passed by the 1st respondent and quash the same and direct the respondents to superannuate the petitioner from service and settle the retirement benefits of the petitioner along with interest @ 12% p.a. compounded annually within a reasonable time. 1/5

ORDER
The relief sought in this writ petition is to quash the orders in DO No.1250/2005 in C No.H1/46673/2004 dated 28.09.2005 passed by the 1st Respondent; RC No.121938/Conf.I(2)/2004 dated 13.08.2014 & RC No.B1/1517/12441/2005 dated 28.08.2014 passed by the 2nd Respondent and C No.H1/08262/2005 dated 03.09.2014 passed by the 1st Respondent and direct the Respondents to superannuate the Petitioner from service and settle the retirement benefits of the Petitioner along with interest @ 12% p.a. compounded annually within a reasonable time.

Today, when this writ petition was taken up for consideration, the learned Special Government Pleader appearing for the Respondents submitted that during the pendency of this writ petition, the Petitioner died on 11.08.2016, consequent to his death, the disciplinary proceedings under Rule 3(b) of Tamil Nadu Police Subordinate Services (Discipline and 2/5
Appeal) Rules, 1955 in PR No.262/2005 pending against him was abated in accordance with G.O.Ms.No.2999, Public (Service) Department Dated 04.12.1969 vide G.O.(2D)No.250, Home (Police-IVA) Department Dated 08.08.2017 and the Petitioner was also allowed to retire from service on 30.09.2005 as per Rule 56(1) of the Fundamental Rules of the Tamil Nadu Government vide proceedings dated 28.11.2017 bearing Na.Ka.No.1/29670/2005 issued by the 1st Respondent. It is further submitted that all the retirement benefits of deceased Petitioner as well as Family Pension have also been given to the wife and legal heir of the deceased Petitioner. The learned Special Government Pleader has produced the copies of relevant orders and proceedings to that effect, before this Court.
3. Recording the above submissions made by the learned Special Government Pleader for the Respondents, this Writ Petition is closed. No costs. Consequently, connected Miscellaneous Petition is also closed. 04.02.2025 mrr Index : Yes/No Speaking Order (or) Non-Speaking Order 3/5
