The application has been filed by the seventh defendant seeking to condone the delay of 34 days in filing the written statement.

2. In the affidavit filed in support of the judges summons, it had been stated that the manager, who dealt with the legal issues in the seventh defendant branch was transferred to another branch and therefore, there was a delay in giving instructions to the counsel to prepare the written statement.

3. Heard the learned counsel for the plaintiff also.

4. The reasons stated are acceptable and the delay is condoned.

5. Registry is directed to take on file the written statement filed by the seventh defendant.
