This Criminal Revision has been filed challenging the order dated 21.01.2025 passed in Crl.MP.No.14663 of 2024 by the Principal Sessions Court Under EC and NDPS Act Cases, Chennai, thereby
dismissing the application seeking return of the property.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner owned a Hundai Car bearing Registration No.TN-12-BH-6401. The said vehicle was handed over to the accused by the petitioner's husband for their use. Thereafter, the vehicle was used by the accused for transportation of 700 grams of Methamphetamine and 6.600 kilograms of Ganja. Pursuant to the seizure of the contraband, an FIR was registered in Crime No.577 of 2024 for the offences under Sections 8(c), 20(b)(ii)(B), 22(c), 25 and 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985. Thereafter, the said vehicle was seized and produced before the Trial Court. The confiscation proceeding is under progress as against the vehicle. Therefore, the Trial Court rightly dismissed the petition seeking return of the vehicle.
4. In view of the above, this Court finds no infirmity or illegality in the order dated 21.01.2025 passed in Crl.MP.No.14663 of 2024 by the Principal Sessions Court Under EC and NDPS Act Cases,
