ORDER
In continuation of the order passed by this Court today the learned counsel for the petitioner had produced a certificate from the Tirupattur Bar Association, which is extracted hereunder:
CONDUCT CERTIFICATE This is to certify that Mr.R.Thanigachalam, B.Sc., B.L.,M.S.No.329/1989 is practicing as an advocate at Tirupattur Court's. He is the member of the Tirupattur Bar Association for past 36 years. He is a senior advocate and Practicing in Criminal as well as Civil Court's at Tirupattur. His conduct is very good.
2.The report from the Judicial Magistrate is contra to the Conduct Certificate. From the report, it is seen that the petitioner though as senior member of the Bar had abused, shouted at the Court Staffs and also against the Presiding Officer. The Presiding Officer had lodged a complaint to the District Judge. From the report it is seen that there is no fault on the Presiding Officer as well as there is no justification for the petitioner to act and behave in such manner.
3.The learned counsel for the petitioner at this stage submits that there is
an uneasy situation prevailing in the Lower Court and he may be permitted to withdraw these Criminal Original Petitions and he would take all earnest steps to resolve the issue through the Tirupattur Bar Association and the Presiding Officer to hear the explanation and also to accept the petitioner's express regret for the unpleasant situation and ensure that no such situation arises again, if such is an undertaking, thereafter the Presiding Officer to take appropriate decision in this regard. This observation is made purely trusting that the issue would be resolved and normalcy would be returned. 4.If any bail application is filed, the same to be considered on the same day.
5.With the above observations, these Criminal Original Petitions are dismissed as withdrawn.
