The petitioner, apprehends arrest for the alleged offences under Section 4(1)(C) & 4(1-A) (ii) of the TNP (Amendment) Act, in Crime No.26 of 2025, on the file of the respondent police, seeks anticipatory bail. 1/4

2. The case of the prosecution is that the petitioner was found in illegal possession of 6 litres of illicit arrack and 2500 kilograms of Jaggery. Hence, the complaint.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Further, the learned counsel submitted that the petitioner has been falsely implicated in this case only for statistical purpose. However, on instructions, the learned counsel further submits that the petitioner is ready and willing to abide by any conditions that may be imposed by this Court and hence, he prays to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that the melted jaggery is only for preparation of liquor. He further submitted that there is no previous case pending against the petitioner. However, he opposed for grant of anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record. 2/4

6. Considering the facts and circumstances of the case and also the nature of the offence committed by the petitioner, this Court is not inclined to grant bail to the petitioner.
