This application has been filed to permit the applicant to lead secondary evidence and consequently mark the photocopies of plaint documents No.6 to 13 in C.S.No.271 of 2015.

The learned counsel for the applicant submits that he has filed photocopies of plaint documents No.6 to 13. Since the originals are not available to lead secondary evidence of plaint documents No.6 to 13. 3.
The learned counsel for the respondents raised objection to the aforesaid submissions.

Considering the submissions on either side, this Court is of the view that it would be appropriate to allow the applicant to lead secondary evidence and mark documents No.6 to 13 and if at all the respondents intend to make any objection, the learned Master is directed to record all the objections of the respondents/defendants. The genuinity of the documents No.6 to 13, will be decided at the time of final arguments.
