Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorari to call for the records pertaining to the impugned proceedings in Na.Ka.No. 3318/ 2020/ SaPa Dated 8.8.2021 on the file of 2nd respondent and quash the same and to grant other relief may deem fit and proper under the circumstances of the case. O R D E R
When the matter came up for hearing on 23.09.2021, this Court passed the following order.
"
Mr.U.Baranidharan, learned Government counsel, takes notice for the respondents 1 and 3.
Mr.A.Selvendran, learned Government counsel takes notice for the respondent 2 and 4.
2.The main grievance that has been expressed by the petitioner is that the proceedings under Section 36(1) of the Tamil Nadu Cooperative Societies Act, 1983 has been initiated based on an enquiry report submitted under Section 81 of the said Act. However, this report has not been furnished to the petitioner. The learned counsel for the respondents shall take instructions and if Section 81 report has not been furnished to the petitioner, the same shall be immediately furnished and reported to this Court. Thereafter, this Court will pass appropriate orders in this writ petition. Post this case immediately after admission on 30.09.2021. Till final orders are passed in the present writ petition, the proceedings shall be kept in abeyance."
2. When the matter was taken up for hearing today, the learned Government Counsel submitted that, the enquiry report was served to the petitioner along with all the relevant documents. Learned Government Counsel also produced the acknowledgment of the petitioner for having received the report and the documents.
3. In view of the above development, the grievance expressed by the petitioner has been redressed and the petitioner is directed to submit the explanation before the second respondent within a period of two weeks from the date of receipt of a copy of this order. The second respondent shall thereafter proceed further in accordance with law and pass final orders on its own merits and in accordance with law.
