This is the Second bail petition filed by the petitioner, who was arrested and remanded to judicial custody on 01.04.2022 for the offences punishable under Sections 8(c), 20(b)(ii)(c) of NDPS Act, 1985 in Crime No.87 of 2022 on the file of the respondent police.

2. The case of the prosecution is that the petitioner and other accused were found in possession of 42.500 Kgs of Ganja, Nitravet-10 mg totally 600 tablets, Tydol- 100 Mg totally 800 tablets and 60 syringes illegally. Hence, a case was registered as against the petitioner.

3. Earlier, this Court dismissed the bail petition filed by the petitioner in Crl.O.P.No.14499 of 2022, on 27.06.2022, considering the fact that the petitioner has failed to fulfill the twin conditions as contemplated under Section 37 of NDPS Act, 1985.

4. Taking into consideration of the facts and circumstances of the case, and that there is no change in circumstances of this case, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
