O R D E R

It is agreed that in view of the existence of the disputes and the arbitration being provided as the mode of settlement of the disputes with the jurisdiction of Chennai Courts not being disputed, as per the joint proposal Mr.Justice N.V.Balasubramanian be appointed as the Sole Arbitrator with liberty to the respondent to raise all defences, including the limitation, as may be available in law.

2. I, thus, appoint Mr.Justice N.V.Balasubramanian,

a retired Judge of this Court as the Sole Arbitrator, to enter upon reference and adjudicate the disputes inter se the parties. The arbitration proceedings will be conducted under the ageis of the Madras High Court Arbitration Centre and the parties will be governed by the Rules of the Centre.

3. The Original Petition is, accordingly, allowed, leaving the parties to bear their own costs.
