ORDER

This Writ Petition has been filed seeking a direction to Respondents to provide adequate police protection to the Petitioner Company, its employees, Vehicles and officials, so as to enable the Petitioner Company to carry out certain cleaning activities for the commencement of quarrying operations in the leasehold lands comprised in S.F. Nos.246/1B and 247/2 (Part), Vadapudur Village, Kinathukadavu Taluk, Coimbatore District.

2. Heard the learned Senior Counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents and perused the entire documents placed on record.

The petitioner is the holder of a valid quarry lease, which was granted by the Joint Director (Addl.Charge), Department of Geology and Mining, Coimbatore by way of a proceedings dated 26.02.2026 in respect of the patta lands to an extent of 2.66.0 Hectares comprised in S.F.Nos.246/1B and 247/2 (Part), Vadapudur Village, Kinathukadavu Taluk, Coimbatore District for a period of five years, I.e., from 26.02.2026 to 25.02.2031 under Rule 20(2)(a) of the Tamil Nadu Minor Mineral Concession Rules, 1959. Earlier, the petitioner's predecessor was granted lease to carry out the quarry operation in

the subject land. While being so, some third parties are obstructing the quarry business of the petitioner without any right or title over the property.

On a perusal of the entire records it is seen that the petitioner has a valid lease to carry out the quarry operation in the subject land and the same was granted by the Joint Director (Addl.Charge), Department of Geology and Mining, Coimbatore on 26.02.2026. When the petitioner is having a valid lease to carry out the quarry operation, no one can prevent the petitioner from carrying out the said quarry operation under the threat of extortion.

In view of the above, the 2nd respondent is directed to provide adequate police protection to the petitioner and his labourers / employees to carry on their quarrying business in the patta land to an extent of 2.66.0 Hectares comprised in S.F.Nos.246/1B and 247/2 (Part), Vadapudur Village, Kinathukadavu Taluk, Coimbatore forthwith.
