Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned transfer order issued by the 1st respondent in his proceedings in No.TNPCS/3749/2025-EW3-12 dated 27.05.2025 in so far as the Serial No.8 (petitioner) is concern, quash the same as illegal, bias and arbitrary and consequently directing the 2nd respondent to permit the petitioner to discharge his duties at the Central Prison, Tiruchirapalli. 1/4

By consent of both sides, this writ petition is disposed of at the stage of admission itself.

The instant writ petition has been filed challenging the transfer order of the petitioner.

It is the fundamental principle that the transfer is an incidence of service and the appointing authority is competent enough to transfer the individual subject to the requirements and administrative exigencies. However, it is the grievance of the petitioner that his wife is serving in Trichy District and therefore, he challenged the transfer order and wants his posting in and around Trichy District.

As we know, it is not a matter of right, however, the petitioner is given liberty to approach the concerned authority by giving a representation within a period of one week from the date of receipt of a 2/4

copy of this order. If any representation is received by the authority, the authority is directed to dispose of the same within a further period of two weeks according to its own merits and in accordance with law. 5.

With the above observation, this Writ Petition is disposed of. No costs.
