ORDER

Heard Mr.L.P.Shanmugasundaram, learned counsel for the petitioner, Mr.S.Ravikumar, learned Special Government Pleader appearing for the respondents 1 & 2 and Mr.U.Baranidaran, learned counsel for the 3 rd respondent.

2. The instant writ petition has been filed claiming retirement benefits viz., Leave encashment, Gratuity and Provident Fund. In the petition, in all the above three heads, the petitioner is claiming a sum of Rs.25,67,845/-.

3. However, the learned Special Government Pleader would strongly object the quantum referred to in the petition, but fairly submitted that they will settle the terminal benefits and other dues of the petitioner.

4. In such view of the matter, without going into the merits of the matter, this Court deems it appropriate to direct the 3 rd respondent to release the retirement benefits of the petitioner with statutory interest @ 10% per annum, within a period of twelve (12) weeks from the date of receipt of a copy of this order. In the event of failure to settle the amount within the above direction, it will carry an interest of 12% per annum till the final amount is settled.
