C.M.A.No.2740 of 2021 against I.A.No.3 of 2019 in O.S.No.360 of 2018 This Civil Miscellaneous Appeal is filed under Section 37 of the Arbitration and Conciliation Act, 1996 against the fair and Decreetal Order passed in I.A.No.3 of 2019 in O.S.No.360 of 2018 on the file of I Additional District and Sessions Court, Tiruvallur.

1. A.Baskar (alias) Pragalanadane .. Respondents This case came up for settlement before the Lok Adalat. Both the parties are present. Mr.G.Ashokapathy for M/s.Pass Associates, learned counsel for the appellants and Mr.P.Dilli Babu, learned counsel for the respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:-

TERMS OF SETTLEMENT Both the parties are present. They have filed a joint memo of compromise and signed by both the parties with their respective counsel and the same was taken on file by the Lok Adalat and same is recorded. The Award (Decree) is passed in terms of the Joint Compromise Memo.

2. In the light of the above compromise, this Civil Miscellaneous Appeal is disposed of as settled. The joint memo of compromise shall form part and parcel of the Award (Decree). It is represented that the second and third respondents herein viz., Nishani Shahan and Chhaya Manohar, has given a letter authorising their mother Mrs.Priti Manohar to sign the award on their behalf and the same is recorded. Award (Decree) is passed accordingly. Consequently, connected Miscellaneous Petitions are closed.

3. The Court fee paid shall be refunded to the Plaintiff in O.S.No.360 of 2018 on the file of First Additional District and Sessions Court, Thiruvallur, in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
