This petition is filed by the State to condone the delay of 184 days in filing the above criminal appeal.
2.Heard the learned Government Advocate appearing for the petitioner. 3.Mr.C.D.Johnson, learned counsel for respondent filed his counter stating that petitioner not given proper reason for the delay of 184 days, only to cause harrassment to the respondent the above petition filed. In this case, even at the time of lodging a complaint by the de-facto complainant there is a delay of 266 days. There was a civil dispute between the parties. Using the victim, a false case has been registered against the respondent. The trial Court on considering the merits acquitted the respondent. The above appeal is only a continuation of harassment. Now the prosecution has taken the role of victim's family. Hence, strongly objected for the condonation of delay. 4.
It is only a condone delay petition, the respondent's objection can be considered at the time of admission of the revision. In view of the same, the delay stands condoned and the petition is ordered. 5.Registry is directed to number the Criminal Revision Case, if it is otherwise in order and post the same for admission. https://www.mhc.tn.gov.
