ORDER

The petitioner, who was arrested and remanded to judicial custody on 06.03.2026 for the alleged offence under Sections 294(b) and 302 IPC in S.C. No.290/2022 before the II Additional District and Sessions Court, Tindivanam, in Crime No.97 of 2022 on the file of respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that the petitioner is

facing trial in S.C.No.290 of 2022 on the file of the learned II Additional District Judge, Tindivanam. He further submitted that the petitioner was regularly appearing before the trial Court on all hearing dates. However, due to his arrest in some other case, he was unable to appear before the trial Court on 20.01.2026, due to which, a non-bailable warrant was issued against him pursuant to the same, he was arrested on 06.03.2026. He also submitted that the petitioner undertakes to appear before the trial Court on all hearing dates without fail and will cooperate for the speedy conduct of the trial. Hence, he prayed for the grant of bail to the petitioner.

At this juncture, the learned Government Advocate (Crl.Side) submitted that trial commenced in the month of March 2025 and subsequently, the Accused did not appear before the Court on 23.07.2025 and in pursuance, NBW was issued and he was able to be secured and produced before the Court only on 29.10.2025. Thereafter, the petitioner was released on bail on medical grounds on 30.10.2025 with a direction to appear before the Court on the date of hearing. But he again absconded, and hence, NBW was issued and he was remanded on 06.03.2026. The trial Court order vide order dated 30.04.2026, dismissed the bail application on the ground that due non-appearance of the petitioner, the trial could not be proceeded with.

Having heard the learned counsel for the petitioner, the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record and taking into consideration of the above circumstances, this Court is of the firm view that it is not appropriate to consider the bail application at this stage.
