Prayer :
Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records connected with the impugned order No.283/Kc/2026 dated 25.03.2026 issued by the first respondent and quash the same as illegal and consequently to direct the respondents to release the petitioner namely, Jeevanantham @ Jeeva (Convict Prisoner, PID No.241081) son of Madheswaran aged about 39 years who is now confined at Salem Central Prison, from the prison on the ordinary leave for 28 days without escort in accordance with law within the time stipulated by this Court.

) Heard both sides.
2. The petitioner was convicted for the offences under Section 376 IPC and Sections 3 and 4 of POCSO Act, 2012 and sentenced to ten years imprisonment. He is undergoing sentence in the second respondent Prison. He seeks 28 days of ordinary leave and his request was considered vide 2/5
proceedings dated 25.03.2026. However, it was stipulated that he will be accompanied by police escort. Aggrieved by the said condition, the present petition has been filed.
3. Taking into account the overall circumstances of the case, we are satisfied that the petitioner can be granted ordinary leave without escort.
3. We direct the respondents to grant twenty eight (28) days of ordinary leave for the convict without escort.
4. The writ petition is disposed of on the following conditions:~ (a) The petitioner/convict-prisoner, Jeevanantham @ Jeeva (Convict Prisoner, PID No.241081) son of Madheswaran, aged about 39 years, confined at Central Prison, Salem, is granted ordinary leave for twenty eight (28) days from 03.06.2026 to 30.06.2026 without escort. (b) The convict prisoner shall be released from the prison at 05.00 p.m., on 02.06.2026 and he shall return to the prison at 10.00 a.m., on 01.07.2026. (c) During the said leave period, he shall report before the Inspector of Police, Senthamangalam Police Station, daily at 07.00 p.m., from 03.06.2026 onwards, without fail.
(d) During the leave period, the convict prisoner shall abide by all the conditions prescribed in the Jail Manual.

(e) It is needless to state that the other conditions set out in the impugned order hold good.
