Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the respondents to consider and appoint the petitioner on compassionate grounds in the post of Driver (or) any other vacancy in the Respondent University.

ORDER

The case of the petitioner is that his father died in harness while working as Mazdoor in regular establishment, on 07.04.2013. Thereafter, he made a representation on 09.12.2014 followed by another representation on 09.06.2015 to the second respondent for compassionate appointment, but no order on such representations having been passed, he came to this Court seeking a direction to dispose of such representation.

2. The learned counsel for the petitioner, submits that since his father was regular Mazdoor, who died after regularisation and his family is in distress, he is entitled to compassionate appointment. However, in the meanwhile he has made representations, but the same having not been considered by

the second respondent, he has come to this Court seeking the relief sought for.

3. In spite of notice issued, none appeared for the respondents.

Regard being had to the facts and submissions made, especially the nature of relief sought for, this Court therefore dispose of this writ petition with a direction to the second respondent to take an informed and considered decision on the representation of the petitioner for compassionate appointment, within a period of six weeks and intimate the decision thereof to the petitioner. However, it is made clear that this Court has expressed no opinion on merits of such representation for compassionate appointment and as such this order should not be treated as a mandate to give compassionate appointment to the petitioner as claimed. In other words, the second respondent is at liberty to take a decision on such representation, if the same is pending as it deem fit and proper but within the aforesaid period.

5. With the aforesaid order, the writ petition stands disposed of. No costs.
