ORDER

(Order of the Court was made by G.R.Swaminathan, J.) Heard both sides.

2. The writ petitioner is a life convict undergoing sentence in Central Prison, Salem. He has already undergone 22 years of incarceration. He applied for 40 days ordinary leave and it was also granted by the first respondent, but, with a condition that he will be accompanied by police escort. Challenging the said condition, this writ petition came to be filed.

3. During the earlier hearing, it was submitted by learned Government counsel that the first respondent had stipulated the said condition only taking into account the petitioner's safety. It was submitted that since a temple festival was to be held, it will not be safe for the petitioner to be present during the

conduct of the event. We adjourned the matter to enable the respondents to get better instructions.

4. Today, when the matter was taken up for hearing, the learned Government counsel submitted that the temple festival was over in the month of April itself.

5. We are, therefore, of the view that the impugned order of the first respondent stipulating the condition that the petitioner should be accompanied by police escort can be deleted and it is, accordingly, deleted. However, the petitioner shall report before the 4th respondent police daily at 7.00 p.m. during the period when he is on ordinary leave. The other conditions hold good. The petition is, accordingly, disposed of.
